Cargo damage claims on a China–Iran TIR truck
A claim starts before the truck moves. Photograph the goods, packaging, shipping marks, pallet condition and seal at the origin hub. At destination, visible shortage or damage must be recorded before the cargo leaves the bonded warehouse. A clean receipt followed by an undocumented complaint is difficult to prove.
- Photograph every side of the package, the loading pattern and the seal number
- Keep the commercial invoice, packing list, CMR, warehouse receipt and survey evidence together
- Write visible damage or shortage on the delivery / warehouse record before collection
- Do not discard damaged packaging until the carrier or insurer releases it
Evidence before departure
The packing list must identify each package by mark, piece count, gross weight and contents. Loading photos should show the undamaged cargo before it enters the trailer, the pallets after securing, and the closed curtain with its seal. For machinery, photograph lifting points and existing scratches. For cartons and bags, show corner boards, straps and any moisture barrier.
What to do at delivery
Inspect before removing cargo from the customs warehouse where local rules allow. Photograph the seal before opening, then the load before handling. Count packages against the packing list. If damage or shortage is visible, write a precise reservation on the warehouse or delivery record: package number, quantity and observed condition. “Subject to inspection” alone is not a damage description.
The claim file
Notify the booking contact promptly and send one complete file: booking reference, commercial invoice, packing list, CMR, origin photos, destination photos, warehouse receipt, written reservation, repair or replacement estimate, and survey report if requested. The carrier and insurer decide coverage under the transport contract and policy; this article does not replace those terms.

FAQ
Should I accept visibly damaged cargo?
Follow your broker and warehouse procedure, but do not sign a clean receipt. Record the exact damage, photograph it and notify the booking contact before the cargo leaves the facility.
Can I throw away the broken crate?
No. Keep the goods and packaging available for survey until the carrier or insurer confirms in writing that disposal or repair may begin.
Who files the insurance claim?
The party entitled under the Incoterm, transport contract and insurance policy. Confirm this before departure, especially where seller and buyer use different insurers.
Does a TIR seal prove there was no damage?
No. It supports cargo integrity between customs points, but impact, moisture, poor securing or forklift damage can still occur. Condition evidence is still required.
